3. Client Responsibilities

• Notify us promptly of unauthorized access to your accounts.
• Comply with all applicable laws related to your use of AI and communication tools, including any obligations to notify third parties that their interactions may be recorded or processed by automated systems.

4. Payment and Billing

• All fees are due as stated in your individual agreement.
• Late Payments: Past-due balances may result in service suspension.
• Refunds: Because services are customized, payments for completed work are non-refundable.
• Taxes: Clients are responsible for all applicable taxes.

5. Intellectual Property

All materials created by Polaris AI Marketing, including web designs, written content, workflows, automation scripts, AI voice agent configurations, prompt architecture, and conversation logic, remain our property until paid in full. After full payment, you receive a non-exclusive license to use the final deliverables for your own business purposes. You may not resell or redistribute them without written permission.

6. AI Systems and Voice Agents

Our AI voice and chat systems assist with lead capture and customer communication. By using these systems, you acknowledge that:

• Some interactions may be automated, recorded, and transcribed.
• Florida is a two-party consent state. You are responsible for ensuring that all parties to any call handled through our system receive proper notice that the interaction may be recorded, prior to the call being connected or recorded. We provide a standard disclosure prompt within our systems, but ultimate compliance responsibility rests with you as the business deploying the service.
• You are responsible for complying with all applicable federal, state, and local communication and privacy laws governing your use of AI and automated communication tools.
• We are not liable for outcomes resulting from automation errors, third-party platform failures, or misuse of the system.

7. Limitation of Liability

To the fullest extent permitted by law, Polaris AI Marketing and its affiliates are not liable for indirect, incidental, or consequential damages, including lost profits or data, arising from your use of our services. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

8. Disclaimer of Warranties

Our website and services are provided "as is" and "as available." We make no warranties, express or implied, regarding accuracy, performance, or availability.

9. Third-Party Services

Our systems may connect with third-party platforms such as GoHighLevel, Twilio, Google, or Meta. Service disruptions caused by third-party platform failures do not constitute a breach of our obligations under these Terms.

Polaris AI Marketing is not liable for delays or failures in performance resulting from causes outside our reasonable control, including but not limited to third-party platform outages, telecommunications failures, natural disasters, acts of government, or other events beyond our control. We will make reasonable efforts to notify affected clients and restore service as quickly as possible.

11. Communications Compliance

By providing your contact information, you consent to receive transactional and promotional messages from Polaris AI Marketing by email, phone, or SMS, as permitted by law. Message frequency may vary, and standard message and data rates may apply. You can opt out of promotional messages at any time by following the instructions in the message or by contacting us directly.
